By visiting this site or making a purchase, you engage with SweetSway and agree to be bound by the following Terms of Service. These Terms apply to all users of the site, including browsers, customers, and content contributors. Please read carefully before accessing or using the site.

1. Online Store Terms

By agreeing to these Terms of Service, you confirm that you are of legal age in your jurisdiction and authorized to make purchases on behalf of yourself or your organization. You may not use the site or products for any illegal or unauthorized purpose.

A breach or violation of any Terms will result in the immediate termination of access to services.

2. General Conditions

SweetSway reserves the right to refuse service to anyone for any reason at any time. While all efforts are made to maintain the quality and security of the website, content may be transferred unencrypted and may involve transmissions over various networks.

Any reproduction, duplication, sale, or exploitation of products, services, or content without written permission is strictly prohibited.

3. Accuracy, Completeness, and Timeliness of Information

Efforts are made to ensure that all information on this site is accurate and up to date. However, SweetSway is not responsible if the information is not accurate, complete, or current. Content is provided for general informational purposes only and should not be relied upon as the sole basis for decision-making.

4. Modifications to Services and Prices

Product availability, descriptions, and pricing are subject to change at any time without notice. SweetSway reserves the right to modify or discontinue products or delivery services (or any part thereof) without notice.

5. Products and Services

SweetSway offers handcrafted petits gâteaux designed for business delivery. Quantities may be limited. All efforts are made to display products as accurately as possible, but actual appearance may vary slightly due to the artisanal nature of the product.

SweetSway reserves the right to limit sales to individuals, geographic regions, or organizations and may exercise this right on a case-by-case basis.

6. Billing and Account Information

You agree to provide current, complete, and accurate purchase and account information for all transactions. This includes a valid business email address and delivery location. If any information is found to be inaccurate or fraudulent, the order may be canceled.

7. Order Cut-Off and Delivery Policy

  • Deliveries are made on Mondays and Tuesdays between 9:00 AM EST and 2:00 PM EST.

  • Orders must be placed by Wednesday at 12:00 PM EST for next week's delivery.

  • Business address verification may be required before delivery is confirmed.
    If no one is available to receive the order, a brief grace period will be observed, after which the delivery may be marked incomplete and subject to a re-delivery fee.

8. Food Allergy Disclaimer & Assumption of Risk

Pastries may contain or come into contact with common allergens, including dairy, nuts, gluten, eggs, and soy. An allergen-free kitchen environment is not guaranteed.

By purchasing and consuming products from SweetSway, you agree that:

  • You assume full responsibility for the safety of anyone consuming the pastries.

  • SweetSway Pastries is not liable for any allergic reactions, illness, injury, or damages resulting from product consumption.

9. Optional Tools & Third-Party Links

The site may offer access to third-party tools or contain links to third-party websites. These are provided “as is” with no warranties. SweetSway Pastries is not responsible for the content, policies, or practices of third-party sites.

10. Intellectual Property

All content—including but not limited to photos, graphics, logos, videos, and product descriptions—is the sole property of SweetSway Pastries and may not be used, copied, or distributed without express written consent.

11. Errors, Inaccuracies, and Omissions

Occasionally, there may be typographical errors or omissions that relate to product descriptions, pricing, availability, or delivery terms. SweetSway Pastries reserves the right to correct these errors and to cancel or refuse any order placed under incorrect information.

In addition to other prohibitions in these Terms, you may not use the site or services:

In no case shall SweetSway be liable for any direct, indirect, incidental, punitive, or consequential damages arising from your use of the products or website, including allergic reactions or spoilage due to mishandling after delivery.

By using this site or purchasing products, you agree to indemnify and hold harmless SweetSway Pastries from any claims, damages, or expenses arising from your breach of these Terms or your misuse of products or content.

15. Severability

If any provision of these Terms is determined to be unlawful or unenforceable, the remaining provisions will remain valid and enforceable to the fullest extent permitted by law.

16. Termination

These Terms are effective unless and until terminated. Failure to comply may result in immediate termination of access to services or cancellation of future orders.

These Terms, along with the Privacy Policy and Delivery Policy, constitute the entire agreement between you and SweetSway.
